Please read carefully this Standard Terms and Conditions of Extended Warranty Service of Sam’s Club (hereinafter referred to as this T&C) before you purchase this extended warranty service of Sam’s Club (hereinafter referred to as the Services).
The Services under this T&C will be provided by Assurant Consulting Co., Ltd. (hereinafter referred to as Assurant) and sold by Sam’s Club (hereinafter referred to as ”Sam’s Club”). Assurant is a professional administrator of after-sale service, and has developed broad and good cooperation relationship with professional repairing institutions. Assurant will arrange for these repairing institutions to handle repairing matters about your products with a malfunction and supervise the quality of their repairing work, with hoping that you will be provided with prompt repairing service with high quality and need not to worry about looking for repairers, negotiating the compensation with them and lodging complaint about their work.
Unless otherwise stipulated in this T&C, the Services under this T&C:
For the entire product, come into effect from the following day upon expiration of manufacturers’ warranty term in its entirety; and
For the major parts, come into effect from the following day upon expiration of manufacturers’ warranty term in this major parts; and
all the Services terminates upon expiration of the extended warranty service term listed in the receipt issued to you. (The “Term of the Extended Warranty Service”)
During manufacturers’ warranty term, the Services under this T&C by no means should cover or replace the manufacturers’ warranty.
This T&C constitutes a basis on which Assurant provides the Services to you. Please take good care of the T&C and receipt of your covered products. You will not be provided with those Services defined in this T&C until showing such receipt and this Standard Terms and Conditions.
一. 服务类别/Service Types
（一）电器/手机数码产品延保服务管理/Administration of The Extended Warranty Service (EWS) for Electronic Appliance, Phone or Digital Products
This EWS only for household electronic appliance, phone or digital products with Actual Paid Price over RMB2000. For the purpose of the T&C, the “Actual Paid Price” means the amount actually paid by you after you attended those promotion activities in Sam’s Club and/or after your use of coupons
During the extended term which commences upon expiration of manufacturers’ warranty term, this Service will arrange for you the provision of the same warranty as the manufacturers’ warranty on the electronic appliance, phone or digital products you purchased（except for the situation under the General Exclusion(article V)）. During the manufacturer’s warranty period for main parts (refer to the manufacturer’s manual for the definition and scope of main parts), service shall be provided by the manufacturer. Repair slip from manufacturers shall be provided when there is repair to main board, or changes to the serial number to the phone, digital products (include mobile phones, digitals, 3C products) during the manufacturer’s warranty period. Including the manufacturers’ whole parts warranty, the total extended service period no more than 6 years from date of purchase (9 years for air conditioner).
2. 额外增值服务管理/Administration of Additional Value-added Service
Administration of This Additional Value-added Service includes three items below:
（1）During both manufacturers’ warranty term and the extended warranty term，this Service will provide repairing service to you with free charge for accessories replacement and any labor thereof on a covered product which incurs a malfunction caused by dust, heat, internal humidity，/power surge/fluctuation. If the covered product cannot be fixed, we will provide a product having comparable function or electronic Walmart gift card as the compensation. The price of both the replacement product and compensation will be determined by Assurant in terms of the present market selling price of the covered product and will not more than the actual paid price of the covered product. 以提供沃尔玛电子购物卡的形式进行补偿, During manufacturers’ warranty term, we will instruct our authorized repairing institutions to provide the same warranty as the manufactures’ warranty and undertake related charges if the manufactures refuse to provide their warranty to your covered products due to the clearance or open-box our authorized repairing institutions conducted.
During the term of this Service, we will replace the functional faulted remote television controller with a new or rebuilt one for free charge one time.
（3）仅针对冰箱或冰柜特别服务管理/Special Administration Service to Refrigerator or Icebox only
During the term of this Service, if the stored food is rotted due to a malfunction of your refrigerator or icebox on which you purchased this Service, we will compensate you with not more than RMB100 (limited)onetime），which will be provided in the form of an electronic Walmart gift card. You shall provide manufacturer’s or our valid repair slip and rotted food receipt (list of rotted food and purchase slip) to us to require such compensation within 30days after reparing.
3. 更换服务。 对于实际支付价格1000元以上的保修商品，在延保服务期内出现故障的，经过我们的授权维修中心三次修理之后，经我们判断仍需要进行第四次修理的，我们将采用具有类似功能的商品来更换，其价格将不超过被更换商品的实际支付价格。能用于更换的商品是经我们判断能够符合原被更换保修商品厂家规定规格的新商品。更换商品的价格可能会因技术革新等原因低于被更换商品的原价格。更换发生时，请根据我们的指示，提供被更换商品的延保小票、本服务条款。您必须在我们同意更换后30天内提取更换产品。请妥善保存您的服务单据，遗失不补。具有请求号码（指在授权维修服务中心的维修记录里记载的编号）的一次功能部件的维修/更换都被视为一次的维修。预防性质的保养检查、清洁、故障诊断、消费指导和附件维修或更换，电脑键盘、音箱、非消耗性笔记本电脑电池或鼠标的维修/更换和软件相关问题的服务均不计入保修政策所指的维修次数
No-lemon Policy. If we determine that a covered product which its Actual Paid Price is over RMB2000 needs a fourth fix after such covered product has been fixed for three times during the term of this Service, we will replace it with a product with comparable function, the purchase price of which will not be higher than the Actual Paid Price of the replaced product. The replacement product must meet the manufacturer’s specifications on the covered product based on our judgment. The price of the replacement product is likely to be lower than the retail price of the replaced covered product due to technology advances. When replacement is provided, the covered product, the purchase receipts and this T&C must be returned to Assurant. You must take back the replacement product within thirty days after we agree to provide the replacement. Please take good care of the documents and we will not provide any more when they are lost. One completed repair or replacement of functional part(s) marked with a service claim number (referred to the number filed in the repair record kept by the authorized repairing center) will be deemed as one fix. Preventative maintenance checks, cleanings, malfunction diagnosis, customer education, accessory repair or replacement, repair or replacement of computer keyboards, speakers, non-consumable laptop battery and mouse, and computer software service are not considered repairs for the purposes of this No-Lemon Policy.
（二）产品置换服务管理/Administration of Products Replacement Plan (PRP)
This Service only applies to the household electronic appliance, phone and digital products at the Actual Paid Price not more than RMB2000. During the service period, after confirmation from our authorized repair center, under this Service you will be provided with compensation equivalent to the Actual Paid Price of a covered product. The compensation shall be electronic Walmart gift card in priority for the purpose of purchasing a replacement of the covered product when the covered product incurs a malfunction. When you get discount from promotional activities and paid the price lower than the original retail price, we will only provide you with electronic Walmart gift card with equivalent money you paid. Under the term of this Service, once you accept the electronic Walmart gift card as equivalent compensation, all our obligations under this T&C are deemed to be fully performed.
（三）针对笔记本电脑、数码娱乐产品和手机/To Laptop, Digital Entertainment Product and Mobile Phone
For the laptop, digital entertainment product and mobile phone you purchased, if you do not choose the EWS or PRP mentioned above, we can provide the service following:
1. 数码延保服务管理/Administration of Digital Extended Warranty Service
This service is the same as administration of The EWS for Electronic Appliance, except that this service come into effect immediately once you purchase the covered product and terminates upon expiration of the extended warranty service term listed in the receipt issued to you.
2. 正常使用意外损坏服务/Administration of Accidental Damage Service In Normal Use
除了提供数码延保服务管理外，对正常使用过程中由于跌落、屏幕破裂，液体泼溅（落水除外）而导致的影响保修商品功能的故障，我们也提供修理或更换服务管理，使其重新恢复正常运行。一旦您的保修商品因意外损坏得到更换，我们在本服务条款项下的所有义务即视为履行完毕。(注意: 本项服务不适用于残次机, 翻新机, 返修机及清仓商品)。
Except for administration of Digital Extended Warranty Service, we also provide the repair or replacement service administration on a covered product which incurs a malfunction caused by drop, broken screen, spilled liquid（except falling into water）. Once your covered product have been replaced due to accidental damage service , all our obligations under this T&C are deemed to be fully performed. (Note: This service not applies to defective products, refurbished products, re-repair products and clearance products).
二. 服务履行/Service Performing
To demand the services under this T&C for the covered product you purchased, please subscribe “Extended Warranty Customers Service” of Assurant official account by Wechat or scan the QR Code on this T&C, or call us at 400-890-7376. We will arrange for our repairing services to provide repairing service to you at their outlets or at your home.
We will arrange for our authorized repairing centers to provide you with in-home service on your covered product on which its manufacturer promises to provide or provided its in-home service to you during the manufacturer’s warranty term in its entirety.
For a covered product on which its manufacturer will not provide the in-home service during the manufacturer’s warranty term in its entirety, you shall, at your own cost, deliver your to-be-fixed covered product to the repairing centers and take back the well-repaired covered product or new replacement product. If we arrange courier service, we will pay such round trip costs for the courier.
Our authorized repairing centers will select to use brand new or rebuilt replacement accessories from their manufacturers, or those accessories not from original manufacturers but meeting the specifications set by them. We are not responsible for your or any other personal items left in the to-be fixed product. The title of the replaced parts after repairment and/or the replaced machines after replacement under this T&C shall be owned by Assurant.
三. 无隐藏费用 /No Undisclosed Charges
There are neither deductibles contained in the services under this T&C nor additional charges for you terminating this T&C.
四. 服务迟延/Service Delay
We will accomplish the repairing work as soon as possible. However, we are not required to assume liabilities for the delay caused by those factors out of our control. The factors include but not are limited to manufactures’ delay, out-of-stock, transportation delay or force majeure.
五. 免责条款 /General Exclusions
本服务条款项下的服务不包含以下情况导致的维修或更换：由地震、洪水、泥石流、火山、台风或沙尘暴等形成的不可抗力；意外损坏（购买了第一条第（三）项服务的笔记本电脑、数码娱乐产品和手机产品意外损坏除外）；故意损坏；火灾；电脑病毒；原装基础上添加的储存数据或电脑硬件的丢失或损坏；液体泼溅或外部受潮/冷凝；昆虫破坏；动物啃咬；误用；滥用；保修商品序列号的涂改或缺失；由非授权维修人员维修或试图维修导致的损坏；未通过我们的服务热线安排而进行的维修；因厂家召回导致的故障或部件和/或人工成本；厂家推荐的日常保养、检修、清洁、添加润滑油、外部调节；电脑软件或电脑软件相关的故障；对商品购置后所添加的硬件进行维修；使用不当；遗失、被盗；屏幕破裂或物理损坏（购买了第一条第（三）项服务的笔记本电脑、数码娱乐产品和手机产品意外损坏除外）；购买本服务条款项下的服务之前保修商品的既有故障；图像滞屏；灯管和灯泡；未发现故障的诊断；在中华人民共和国大陆领域外发生的故障；保修商品用于公共、商业、租赁或多用户非家庭用途（如出租、洗衣店、复印店、健身房、宾馆、饭店、网吧、集体宿舍、营业场所使用、公共场所使用等）。本服务条款项下的服务不涵盖保修商品的附加配件或者耗材，诸如真空吸尘器袋、电池、充电器, 电源适配器, 剃须刀网刀头, 色带、墨粉和墨盒、触笔、灯泡、磁带和磁盘等（如厂家的整机保修范围如包含该等附加配件或耗材的，则不适用本项内容）。本服务条款项下的服务不涵盖不影响功能的外观损坏。本延保服务管理亦不涵盖因商品故障而导致的任何信息或数据丢失。您应当负责对所有的储存数据保留备份。我们对任何间接损失或附带损失（包括但不限于，无法使用、业务损失、利润损失、数据损失、故障时间损失及误工费）不承担任何责任。我们对产品在服务期以外的期间内发生的任何故障不承担任何责任。
The services under this T&C does not cover repairs or replacements necessitated by such “Acts of Nature”：as earthquake, flooding, landslide, volcano, typhoon, sand storm and etc., accidental damage(except for those who purchase laptop, digital fun, cell phone accidental damage handling (“ADH”)；intentional physical damage; fire; computer viruses; loss or damage to stored data or computer hardware that is added after the original purchase; spilled liquid; external humidity/condensation; insect infestation; rodents; misuse; abuse; altered or missing serial numbers of the covered product; damage caused by repair or attempt to repair carried out by non-authorized repair personnel; repair not arranged by our service hotline; failures or parts and/or labor costs incurred as a result of a manufacturer’s recall; ordinary maintenance, check, clearance, adding lubricant, external adjustment suggested by manufactures; computer software or computer software related failures; repair of the hardware attached to product after purchase; the use of your covered product in a manner for which it was not intended; loss or theft of the covered product; cracked or physically damaged screens(except for those who purchase laptop, digital fun, cell phone accidental damage handling (“ADH”)); failures that occur prior to the purchase of the services under this T&C; image burn; lamp bulb, no fault found diagnosis, defects that occur outside Mainland China; any product used for public, commercial lease or multi-user non-household purpose (such as rental, laundry, copy center, gyms, hotels, restaurants, internet bars, dormitory, business or public places, etc.). The services under this T&C do not cover accessories or consumables damage of covered product, such as vacuum cleaner bags, battery, charger, power adapter, razor cutter head, ribbon, toner and cartridges, touch pen, bulb, tape and disk and etc. (unless the manufaturers have covered these into their whole parts warranty). The services under this T&C do not cover cosmetic damage which does not influence the functionality of the product. The services do not cover loss of any information or data that results from a product failure. You shall be responsible for the data back-up. We will not be liable for any consequential or incidental damages, including but not limited to loss of use, loss of business, loss of profits, loss of data, down-time and charges for time and effort. We are not liable for any breakdowns happen to the product outside of the service period.
六. 责任限额六/Limit of Liability
The limit for our liability for each claim under this T&C is the lowest cost of the following three categories: (1) authorized repair; or (2) product replacement having the comparable function; or (3) compensate with equivalent electronic Walmart gift cards. The limit for our maximum liability under this T&C is the Actual Paid Price for your covered product. If we assumed liabilities of (2) or (3), we will be deemed to have successfully performed all obligations under this T&C.
七. 免费转让/Free Transfer
During the term of this T&C you may transfer all rights and duties under this T&C to a new owner when transferring your covered product to him/her. You are not required to pay us any additional fees for such transfer. The purchase invoice (if any) , receipt of the covered product and all repairing records must be transferred to the new owner simultaneously.
八. 终止 /Termination
We may terminate this T&C if you commit any fraud (including but not limited to leasing your covered product) or material misrepresentation. If you have your covered product repaired by any unauthorized repairer, we may also terminate this T&C. This T&C will automatically terminate if your covered product is replaced or compensated during the term of this T&C. You may go to Sam's Club stores where you purchased the services with this T&C and purchase invoice (if any) or receipts of your covered product to terminate this T&C without any cause (1) within seven days after purchase date of this T&C as to mobile phone, digital entertainment products and laptop, or (2) within thirty days after the day you purchase this service and then receive a refund per ratio after we deduct our actual cost for provision of the Services. Except in such situation, you shall not unilaterally terminate this T&C.
九. 数据使用及保护/Data Use and Protection
You understand and agree that we will appoint a third party, including but not limited to the authorized service center, associated company, employee and sales representative to provide the services under this clause, including matters concerned with handling your subscription, charging for service fees and verifying your identification as the Customer, etc. You agree that, for the purpose of providing you with the services under this clause, we can (a) collect, use and release your (i) name, passport number, ID number, address, contact number and E-mail; (ii) your information related to our services, including calls, bills, your geographical location and information of products subject to maintenance; (iii) information related to your payment, such as information of your bank account or credit card; (iv) your information provided in the customer information registration sheet or our customer feedback survey; and (b) reserve such information based on the purposes for us to perform the services, handle the bills, prevent fraud and conduct risk management as well as other purposes in accordance with the legal requirements. You hereby understand, know and agree the information above mentioned upon each time you use our services and we provide you with services. We hereby notify you that we or a third party will use your information to acquire/extract other information related to our services. Such information, however, is integrated with no information of personal identity can be recognized, including but not limited to consumption, information related to product and service request. Such information is extracted only for purposes of review, development or improvement of our services.
十. 争议解决 /Dispute Resolution
For any dispute arising from or in connection with this T&C, parties shall negotiate to solve first. If negotiations fail, parties shall submit the dispute to one of the options below (please click for your preferred way for dispute reolution):
□ the China International Economic and Trade Arbitration Commission located in Beijing to be arbitrated according to its then valid arbitration rules. The arbitration ruling is final and binding on both parties; or
□ The local court where the defendant is located.
十一. 全部协议/Entire Agreement
This T&C constitutes the whole agreement in relation to the Service. The in-store publicity, announcement, commitment or conditions not contained in this T&C shall not in any way amend this T&C. This T&C cannot be amended mannualy. Any amendment will be regarded as invalid. If transfer happens as per Section VII above, please note the personal information of the new owner besides the information of the original owner by handwriting.
The following terms used in this T&C have the meaning specified below：（1）“: (1) “We” or “Our” means Assurant, the provider of the Services under this T&C; (2) “You” and “your” means the consumers who purchase products and the Services under this T&C thereon; (3) “Covered product” means the product purchased by the customers from Sam’s Club and covered by the Services under this T&C; and (4) “Service(s)” means those administrative services provided by Assurant as to the arrangement of repair or replacement of the covered products.
十三.声明及签署 / Statement and Execution
The Services under this T&C will be provided to you directly by Assurant Consulting Co., Ltd., who undertakes corresponding obligations. Sam’s Club is only responsible for the sales of the Services under this T&C. If you have any questions, please call Assurant’s consumer service hotline: 400-890-7376.。
Assurant Consulting Co., Ltd. reserves the right to change the Services provider under this T&C. If Assurant needs to change the Services provider under this T&C due to business needs, Assurant Consulting Co., Ltd. will announce such the new Services provider and new consumer service hotline with appropriate manner (including entrusting Walmart to publish related notice in Walmart stores).
